Privacy Statement

MACP (hereinafter may be referred to us “MACP”, “we”, “us”, “its” or “our/(s)”) is committed to safeguarding the privacy and security of your personal information by securing and managing it in accordance with its legal responsibilities pursuant to applicable data protection laws, particularly, the Malaysia Personal Data Protection Act 2010 (hereinafter referred to as the “Act”). For the purposes of this Privacy Statement (hereinafter referred to as “Statement”), the terms “Personal Data” and “process” and/or “processing” shall have the meaning as prescribed in the Act.

By using MACP Website, applications or by otherwise providing MACP your Personal Data, you are accepting the practices described in this Statement.

  1. Source of Personal Data

      When visiting the MACP Website, we may collect certain types of personal data which may include the following:

    1. Information relevant to your dealings, membership with and/or matters connected to MACP, including but not limited to name, identification card or passport number, pseudonyms, address, phone number, bank account details or information otherwise generated upon your access to MACP’s website or related applications and in the course of your dealings with MACP;
    2. Information relevant to the usage of MACP website, including but not limited to username, IP base number, password and other information required during the online registration and/or login process.
  2. Use of Personal Data
    1. MACP may process the Personal Data collected through its website for the following purposes:
      1. To administer its member’s account and to meet its legal obligation to ensure the security of your data and of the website;
      2. To respond to inquiries and provide information requested by members and/or visitors;
      3. To send members newsletters and/or notices in respect of any updates, developments, marketing information and information concerning MACP’s role, functions and/or objectives, licences and membership related matters;
      4. Administering member and licensee records;
      5. Maintaining information as a reference tool or general resource;
      6. Responding to any matter which requires MACP to use your information for the purpose of providing transparency and/or clarity, or for the purpose of defending allegations against MACP or rectifying any misrepresentation or inaccuracy;
      7. Presenting your information for the purpose of reporting where it is required in the furtherance of MACP’s functions and/or objectives;
      8. Sharing your information with MACP’s approved third-party suppliers or vendors;
      9. When required by law, regulation, legal proceedings, or in response to a valid request from governmental authorities; and
      10. For any purpose incidental, ancillary or in furtherance to the above mentioned purposes.
    2. MACP may disclose this personal information to:
      1. Its related entities;
      2. Overseas collecting societies that administer the performing rights to musical works and that have a reciprocal agreement with MACP;
      3. Expert advisers to MACP who have been engaged to provide MACP with legal, administrative, financial, research or other services;
      4. Service providers, supplier or vendors who support MACP in its operation while adhering to appropriate confidentiality and security protocols;
      5. When required by law, regulation, legal proceedings, or in response to a valid request from governmental authorities, industry regulators and statutory authorities;
      6. Any other party that MACP deems necessary for the purposes as outlined in item 2.1.
  3. Data Security

      Where MACP discloses your personal information to third parties, MACP will ensure that those parties are bound to abide by MACP’s or equivalent, personal information practices and policies relating to the collection, processing, disclosure and retention of your personal information.

  4. Your Rights

      You have the right to access the Personal Data held by MACP pertaining to you. For this purpose, you may contact MACP by writing to general@macp.com.my.

      MACP will process your request within a reasonable time and, in the event the request cannot be granted in full, MACP will inform you of the information it keeps about you in general. Please note that any identification information provided by you to MACP will only be processed in accordance with, and to the extent permitted by applicable laws.

  5. Changes to MACP’s Privacy Statement

      MACP reserves the right to modify, update and/or amend this Statement from time to time. The updated version of this Statement shall be effective as of the specified updated date indicated at the end of the same.

      This Statement shall be read together with the relevant MACPLicence Application Forms and Licence Agreements.
