  • Gross Revenue refers to revenue received and receivable, including but not limited to the subscription fee, service fee, advertisements and sponsorship payments, and any benefits in kinds, perks, virtual gifts, barter trades advantages or consideration (which shall be calculated based on their estimated monetary values).
  • Minimum Guarantee refers to a non-refundable minimum fee which is recoupable against payable licence fees in consideration for the licence granted, to be paid by the Licensee in advance to MACP prior to the issuance of any licence.
  • Music content refers to any music centric content (audio and/or audio-visual material incorporating one or more musical works), including but not limited to concerts, music videos, audio music tracks, singing contests and music-centric games where the musical works are the main focus.
  • General Entertainment content refers to any non-music centric content (audio and/or audio-visual material incorporating one or more musical works), where the musical works are not the main focus (e.g., TV shows, films, audio books). For the avoidance of doubt, music videos do not constitute General Entertainment Content.

  • Mechanical Music: Music played using recordings, including digital files, CDs, DVDs, tapes, radio or TV. It also includes music copied onto devices such as tablets and smartphones, mainly used as background music.
  • Featured Music: Music played by a DJ or used for karaoke, where people sing along. It includes music from recordings, digital files, CDs, DVDs, tapes, radio, TV, or devices like tablets and smartphones.
  • Live Music: Music performed live by singers, bands, musicians, dancers, models, or conductors.

Our representation extends to songwriters in Malaysia and also those in most foreign countries.

The song "Billie Jean" written by Michael Jackson and the song "Love Story" written by Taylor Swift used in Malaysia will be administered by us and then distributed back to them individually via our US counterpart, BMI.

Our representation extends to songwriters in Malaysia and also those in most foreign countries.

The song "Billie Jean" written by Michael Jackson and the song "Love Story" written by Taylor Swift used in Malaysia will be administered by us and then distributed back to them individually via our US counterpart, BMI.

MUSIC COPYRIGHT
AND LICENSING

Under Malaysia Copyright Act 1987, you need permission from each songwriter before using their music. Songwriters are compensated in exchange for allowing you to use the music. However, your permission process may become impractical and nearly impossible when it involves many individual songwriters.

At MACP, we simplify this process for you, ensuring a swift and proper permission process. The licence fees you pay are then distributed as royalties to our songwriter members. Just as you earn a living from your job, MACP members rely on fair compensation to sustain their livelihood and continue producing music that benefits everyone.

Cost
100% of the licence fees minus administrative costs will be distributed back to songwriters when their music is used, tracked and licensed. We are one of many collective management organisations that have consistently maintained low administrative costs compared with similar organisations.
Licence Fees
Our licence fees are set based on various factors such as the type of music used, how and where it is used. As such, different usages will have different fees. Music-centric businesses will have to pay higher licence fees than non-music businesses because of the difference in value it brings to their business.

MACP offers various licences for your use:
  • Licences to use live and/or recorded music (including background music on a CD, radio or stream online) in business settings like restaurant, lounge, store, etc and to be renewed annually.
  • Licences for use the live and/or recorded music (including background music on a CD, radio or stream online) in events such as concerts, carnivals, dinners, wedding etc.
  • Licences for online usage such as Website, Social Media, Streaming Services, Downloading Services, User-Generated Content, General Entertainment Over-the-Top and Internet.
  • Licences for broadcast stations such as Terrestrial radio and television, and Satellite radio and television.

Your subscription with these platforms and similar services only allows you to use them in your personal capacity. A MACPLicence allows you to play those subscription music in a public setting and the fees vary depending on your usage.
We cover a wide repertoire, which consists of majority of copyrighted music. However, music that is no longer protected by copyright, not assigned to us/directly licensed and royalty-free or royalty-paid are not covered by a MACPLicence.
