MACP Awards Night 2012
A total of 11 awards were presented to members at the annual dinner cum awards presentation held at the new Royale Bintang Damansara Hotel and hosted by Hot FM Dj, AG!

A special award was given to Mr Ang Kwee Tiang, Regional Director CISAC Asia Pacific as appreciation for his contribution towards MACP’s set-up and development. Ramli Sarip received the Anugerah Cipta Lagu whilst Dato M Nasir grabbed the Top Composer Award for the 12th time!

Pn Habsah Hassan took home the Top Lyricist award for the first time whilst the Most Promising Young Composer award was given to Low Weng Fai. Weng Fai, aged 24 has written songs for many local and foreign artistes and many of his compositions were used as theme songs in many local drama productions.

The audience were entertained with evergreen songs performed by artistes such as Fredo, Rohana Jalil, Herman Tino, Asmidar, Feroq, Shiela Abdul and Aryan band. Past award recipients were invited to be presenters for the awards which they won in earlier years.

MACP declared as Licensing Body
MACP has been declared as a Licensing Body under Section 27(A) of the Copyright Act, 1987 (332 Act) and Copyright Regulations (Licensing Body) 2012. The Certificate issued on 28 September 2012 by Yg Bhg Dato’ Azizan Mohamad Sidin, Controller of Copyright, Malaysia was handed over to MACP’s General Manager, Chan Miew Lan recently.

MACP is the first Licensing Body in Malaysia to be declared as a Licensing Body under the newly enforced amendments to promote transparency, accountability and good governance amongst licensing bodies.

National Creative Industry Policy (Dasar Industri Kreatif Negara “DIKN”)
We are pleased to inform members that the under the Government’s Economic Transformation Programme (ETP), the creative industry has been identified as one of the key growth drivers of the country’s GDP. Amongst others, is to encourage local talents to create more quality music that can be exported overseas.

A budget has been approved under DIKN for 2012-2013 for execution of the following programmes :-

1) MTV Matching Grant Application Form Guidelines
2) Overseas Tour Support Application form Guidelines

We believe the above financial assistance is a timely boost for the development our local music industry. A committee to oversee these programmes has been set up under the coordination of the Ministry of Information, Communication & Culture with the assistance of RIM.

MACP won appeal against A’Famosa Water Theme Park
The Court of Appeal recently dismissed an appeal by A’Famosa Water Theme Park and reaffirmed MACP’s rights under the Licence Agreement executed by both parties on 1 January 1997.

MACP had sued A’Famosa Water Theme Park Sdn Bhd for a sum of RM64,160.00 being non-payment of licence fees for the period from 1998 to 2003 under the said Licence Agreement for the right to publicly play music within the repertoire controlled by MACP at its theme park.

MACP had earlier successfully appealed at the High Court against the decision of the Sessions Court which had dismissed MACP's claim. This High Court decision was later appealed by A’Famosa Water Theme Park Sdn Bhd.

During the hearing at the Court of Appeal on 19 July 2012, it was heard that A’Famosa had paid the licence fees for the year 1997 and part of 1998 but failed to settle the rest of the licence fees including licence fees from 1999 up to 2003. There was also no dispute by A’Famosa over the validity of the Licensing Agreement during the period when the invoices were issued by MACP.

As the claim was contractual in nature, the Court of Appeal held that there was no need to delve into the issues of copyright ownership or the locus standi of MACP to issue and enforce the Licence Agreement, as the claim was not a copyright infringement matter.

The Court of Appeal then upheld the decision of the High Court and dismissed the Appeal with RM10,000.00 in costs. MACP was represented by Messrs Wong & Partners and A’Famosa Water Theme Park Sdn Bhd was represented by Messrs K.P. Ng & Amardas.

MACP’s 22nd Annual General Meeting
This year’s AGM saw one of the biggest turn out by members in recent years. We hope to see members continue to support and take an interest in the Company’s affairs.

The meeting discussed and made the following decisions: -

1) Received and adopted the Financial Statements for the year ended 31 December 2011 and the Reports of the Directors and Auditors thereon.
2) Re-elected Pn Habsah Hassan and Ad Samad as Writer Directors and elected Jackie Urban Poh of NSR Music Publishing Sdn Bhd as the Local Publisher Director replacing Norkhayati binti Mohd Hashim from Kelarai Sakti Publishing Sdn Bhd.
3) Re-appointed Ernest & Young as Auditors of the Company and authorized the Board to fix their remuneration.

Members were updated on the financial performance of the Company for the year 2011 by the Chairman. Gross Revenue grew by 14% to RM41.2m compared to RM36.1m in the previous year. General Licensing recorded a 12% growth, Broadcast 9% and New Media grew by a significant 29%! General Licensing contributed 57% of the Total Revenue, while Broadcast constituted 24%, New Media 16% and the balance 3% came from Other Income such as interest. Despite the 14% revenue growth, expenses were contained at RM3.4m representing a 6% increase resulting in an Excess Revenue before taxes of RM37.8m or a 15% growth from RM32.9m in the year 2010.

Membership now stood at 2,995 comprising 2,881 writers and 114 publishers. 73% of the members are Full Writers members and 3.1% are Full Publisher members. Several membership activities were organized since the last AGM namely, briefing for members on 29 July 2011 and 3 April 2012. The next briefing for new members will be held on 17 July 2012. A Hari Raya Open House with the media, radio DJs and orphans from Rumah Amal Cahaya Tengku Ampuan Rahmah was held on 22 September 2011; followed by the MACP Awards on 29 November 2011 and the recently concluded Cipta Ekspres on 11-14 June 2012.

Members also approved the purchase of a Group Personal Accident Insurance policy for the directors of the Company. The Chairman later briefed members on recent developments on the legal from following the implications of the enforcement of new Acts this year, namely the Copyright Act (Amendments) 2012, Competition Bill 2010 and Personal Data Protection Act 2010 on MACP and other developments in the music industry.

Members also voiced their concerns on the low royalty fees paid by the Government for the use of the music over RTM TV and radio stations and Government events. The meeting also decided not to renew the agreement when it expires end of this year and to negotiate for a better deal for the members which commensurate the usage of music by the Government.
11 - 14 June 2012 :
The 8th Cipta Ekspres workshop concluded successfully with a bounty 18 new songs.

This year’s Cipta Ekspres saw participation from Ajai, Neves Pretty Ugly, Rosli Ahmad, Jipie Pesawat, Ito Lara, Bard, SISO, Ireani Yaacob, Azam Dungun, Wan Namiron, Jart Hassan, Keroz Keynote, Eenaz Mokhtar, Yabang, Lufya, Fajrul Norman, Fadzli Far East and Fetri Yahya.

The 18 composers & lyricists were grouped into 9 groups and were challenged to compose one fast song & a ballad. Each was asked to bring one melody or lyric to the workshop for his/her partner to complete the song. They were assisted by arrangers such as Riza, Firdaus, Gjie 6 Sense, Along Exists and Bard Muffins who were engaged by MACP in the songs arrangement. As a result, the 18 songs produced from this workshop were considered a finished product with proper arrangements.

As a finale, the 18 new songs were showcased at the last night before representatives from members of the press and several record companies such as Warner Music, Nova Music, Siti Nurhaliza Productions and Erama Records who were there to find suitable songs for their artistes.

To make the event more exciting, a panel jury selected amongst members of the audience picked their Favorite Song for the evening. The winning song, Sedia Bercinta Lagi composed by Keroz Keynote & Eenaz Mokhtar won RM1,000 cash prize.
21 to 22 May 2012 :
CISAC/BIEM Asia Pacific Committee Meeting
After 18 years, the CISAC Asia Pacific Committee meeting finally made its way back to Kuala Lumpur. Representatives from 13 authors’ collective management organization from the Asia Pacific including, for the first time from New Caledonia attended this meeting.

Also present were Mr Oliver Hinnewinkel, Director General CISAC, Mr Ronald Mooij, Secretary General, BIEM, Mr Ang Kwee Tiang, Regional Director, CISAC, Asia Pacific and representatives from ASCAP, BMI, MCPS-PRS, SACEM, SGAE and SOCAN bringing a total of 28 participants, the highest attendees ever for a CISAC/BIEM Asia Pacific Committee meeting!

The meeting, chaired by Mr Scot Morris, Chairman, CISAC Asia Pacific Committee was held at MACP’s new office. Besides country reports presented by each society’s representative, the meeting discussed on New Media and International Satellite TV Broadcasters licensing developments, implementation of Professional Rules & Compliance Visits, Training & Education Activities by CISAC, WIPO and other Governmental agencies in the region. There was also a presentation by Barcelona Music & Audio Technology (BMAT), which provides music monitoring and identification services.

MACP inks deal with YouTube
YouTube, the world’s largest online video sharing community today announces the launch of a localized service for Malaysia. In anticipation of the Malaysian service, YouTube has signed a licensing agreement with MACP that will allow Malaysian songwriters and composers represented by the local collecting society to earn revenue on YouTube.

In a press release, Adam Smith, Director of Product Management of YouTube in the Asia-Pacific region said, “Over the last few years Malaysian have been watching YouTube in high numbers and by launching a version of the site optimized for Malaysia today, we aim to create an even more relevant local YouTube experience. Revenue is generated when advertisements are displayed against YouTube Partner’s videos. Under this agreement, Malaysian authors will now receive payments from their association when rights holders distribute them.”

“We are excited to ink this deal with YouTube as it will pave the way for new revenue opportunities for our members and affiliates” says Ms Chan Miew Lan, General Manager from MACP. “YouTube is extremely popular amongst Malaysians and we are pleased of this decision to monetize the traffic which will benefit songwriters and music publishers when their music is used on YouTube”.
