15th Annual MACP Awards

The 15th annual MACP Awards was held on 3rd December 2010 at Hotel Crowne Plaza Mutiara Kuala Lumpur with the Minister of Domestic Trade, Cooperatives & Consumerism, YB Dato’ Sri Ismail Sabri b Yaakob gracing the event as the Guest-of-Honour.

The awards ceremony saw the conferment of 9 awards based on the royalty collection and 2 special awards, namely the Nadi Cipta Award for an outstanding individual for his achievement and contribution to the local music scene and the Most Promising Young Composer Award. As a show of appreciation, personalities from radio stations ie Linda Onn & Halim Othman (Suria FM), Mustaza Maah & Noraini Ibnu (RTM), Isma Halil & Rezlynn (THR Gegar), Suraya & Ikhwan (Hot FM) and Abby Fana & Rustam (Sinar FM) were invited to present the awards.

29 - 30 November

Training of General Manager, MRCSN

The newly appointed General Manager of the Nepalise society, Ms Dikccha Gautam attended a 2-day training at MACP’s office. The training focused on licensing to assist her in expanding the licensing activities to the general music users. Ms Dikccha was also trained on other areas namely membership, documentation & distribution.

Music Royalty Collection Society Nepal (MRCSN) was set up in 2007 and was admitted to CISAC as a Provisional Member in 2009. It made its first distribution in January 2010 from ringback tone digital downloads collections.

MACP entered into a reciprocal agreement with MRCSN in year 2009. This means that Nepalise songwriters works are administered by MACP in Malaysia whilst MACP’s members’ works will be handled by MRCSN in Nepal.

25 - 26 November

CISAC/BIEM Regional Licensing Workshop

Following the CISAC CTRTV Conference, the CISAC/BIEM Regional Licensing Information Exchange Workshop was held in Kuala Lumpur. A total of 30 participants from Asia Pacific attended this workshop. Amongst the speakers were Ms Gerie Meier from Buma/Stemra (Netherlands), Mr Eduardo Falcone, SADAIC (Argentina), Mr Richard Davidson (APRA, Australia), Mr Geoffrey Lau (CASH, Hong Kong)and Mr Kay Yamaguchi (JASRAC, Japan).

The workshop focused on new media licensing developments and licensing of satellite and cable operators in the Asian Region and in Netherlands, Argentina & Australasia.

23 - 24 November

CISAC CTRTV Conference

It was a great honor for MACP to jointly host with CISAC the 2-day Radio & Television Technical Committee Conference in Kuala Lumpur. The conference saw participants from over 30 countries from across the American, European, African & Asian continents attending this annual meeting of broadcast and new media experts.

Amongst the topics discussed were multi-territorial & user generated contents licensing models and ISP liabilities. There was a special focus on the Asia Pacific region where representatives from each country in the region gave an overview of the broadcast & new media scenario in their countries over the last 10 years.

MACP hosted a Welcome Dinner at Saloma Bistro & Threatre Restaurant where the delegates were entertained with cultural performances by Saloma dancers.

Training of General Manager, MCT

MACP also conducted a brief training session for Ms Jittrapa Payacko (Benjy) on documentation & distribution when she was in Kuala Lumpur for the CTRTV Conference. The training was conducted by MACP’s Documentation & Distribution Manager, Ms SK Ng.

Criminal Actions against Entertainment Outlets in Klang and Kuala Lumpur

On 1 September 2010, a team of enforcement officers, lead by Tn Mohd Hafix Emran from the Ministry of Domestic Trade, Cooperative and Consumerism (MDTCC), Selangor branch raided and seized audio-visual equipments from an entertainment outlet located in Klang following a complaint from MACP.

During the raid, songs under MACP’s repertoire such as ‘Kerana’ , ‘Andainya Aku Pergi Dulu’ popular numbers by Alleycats and ‘Tong Hua’ by Michael Wong were identified to be publicly performed at the pub which did not have a MACP licence.

MACP has also lodged another complaint, this time with the MTDCC Kuala Lumpur branch against a karaoke lounge in Medan Imbi, Kuala Lumpur for playing music in public without a MACP licence. The karaoke lounge had ignored repeated warnings by MACP since 2006 and was raided by 20 enforcement officers from MTDCC and MACP lead by Encik Mohd Fahmie Rusli on 21st September 2010. During the raid, karaoke devices together with a server were seized from the outlet. The seized server purportedly contained more than 30,000 songs all of which were suspected to be pirated copies.

Under section 41(3) of Copyright Act 1987, “any person who caused a musical work to be performed in public without the copyright owner’s consent shall be guilty of an offence”. The penalty of each offence under the Act involves fines ranging from a minimum RM 10,000 to RM 50,000 and up to 5 years’ imprisonment per offence.

SEAMEO Song Writing Competition (Closing Date 30 September 2010)

The Southeast Asian Ministers of Education Organization (SEAMEO) is an international organization, established in 1965, to promote cooperation in education, science and
culture in Southeast Asia.

The SEAMEO Songwriting Competition (SSC) is a search for that passionate songwriter who could put the SEAMEO spirit of cooperation into words and melody. The
SEAMEO hymn will symbolize the unity of the Southeast Asian nations in the promotion of cooperation in education, science and culture in the region. The song will echo the
aspiration of the SEAMEO forebears; and will serve as the SEAMEO anthem in the gatherings and events of the Organization.

The Competition is open to all citizens of SEAMEO Member Countries, namely: Brunei Darussalam, Cambodia, Indonesia, Lao PDR, Malaysia, Myanmar, Philippines, Singapore,
Thailand, Timor-Leste and Vietnam. Amateur and professional songwriters/ musicians, educators, students are invited to participate in the competition.

: Majlis Penyerahan Cek Royalti kepada Pewaris-Pewaris Tan Sri P Ramlee

Kementerian Perdagangan Dalam Negeri, Koperasi dan Kepenggunaan (KPDNKK) melalui Perbadanan Harta Intelek Malaysia (MyIPO) telah mengadakan Majlis Penyerahan Cek Royalti (MACP) bagi karya-karya Allahyarham Tan Sri P. Ramlee kepada kesemua 8 pewaris Allahyarham Nasir P Ramlee pada 10 Ogos 2010 bertempat di Hotel Le Meridien.

Majlis ini telah disempurnakan oleh Y. B. Dato' Ismail Sabri Bin Yaakob, Menteri Perdagangan Dalam Negeri, Koperasi dan Kepenggunaan. MACP diwakili oleh Pn Habsah Hassan, Pengerusi dan ahli-ahli Lembaga Pengarahnya serta ahli-ahlinya.

: MACP’s 20th AGM

MACP’s 20th AGM was successfully held on 16 June 2010.

The meeting re-elected writers, Pn Habsah Hassan and Ahmad Shahadrian A Samad (Ad Samad) as directors. Also re-elected was local publisher, Pn Norkhayati Mohd Hashim representing Kelarai Sakti Sdn Bhd. The 3 directors will serve for another 2-year term on MACP’s Board.
The meeting passed the audited financial statements of the Company for the year ended 31 December 2009 and the Reports of the Directors and Auditors thereon. Messrs Ernst & Young were re-appointed as the Company’s Auditors.

The meeting also passed as special business amendments to the Company’s Articles of Association to increase the Board from the present 10 to 12 directors. The new Board shall comprise 6 writers and 6 publishers from which 2 publishers shall be Local Publishers. In addition, the quorum for a Board meeting will now be 6 directors comprising 3 writers and 3 publishers. The approved amendments will be effective next year.

An ordinary resolution was also passed by the members to give effect to the Directors to purchase a building for the Company for a consideration of not exceeding RM5.0million.
Members were also updated on the MACP’s latest activities, membership and current developments in the industry with regards to the proposed amendments to the Copyright Act, 1987, song production contracts and Koperasi Industri Muzik Malaysia Berhad.

: PERTANDINGAN CIPTA LAGU IRAMA MALAYSIA 2010

Jabatan Kebudayaan Dan Kesenian Negara dibawah Kementerian Penerangan Komunikasi dan Kebudayaan (KPKK) dengan kerjasama MACP akan menganjurkan Cipta Lagu Irama Malaysia pada 24 Julai 2010. Pertandingan ini terbuka kepada semua pencipta professional dan amatur Malaysia. Ahli-ahli MACP digalakkan untuk menghantar lagu-lagu baru mereka.
Pertandingan Akhir akan bertempat di KL Live Hall, Life Centre pada 24 Julai 2010 bersempena bulan KL Festival 2010.

Hadiah untuk Johan adalah RM10,000; Naib Johan RM8,000; Ketiga RM6,000 dan Saguhati (5) RM1,000.

Syarat-syarat pertandingan :-
1) Terbuka kepada semua warganegara Malaysia berumur 15 tahun keatas
2) Tarikh tutup 31 Mei 2010
3) Lagu mestilan baru dan asli yang belum diterbitkan oleh syarikat rakaman, syarikat penerbitan atau persembahan luar.
4) Lagu digalakkan mempunyai elemen keroncong, dondang saying, dikir barat, inang, joget atau zapin
5) Muzik digalakkan mempunyai unsur muzik Sabah, Sarawak, Cina, India, Orang Asli, Portugis, Bangra atau Arab/Parsi
6) Penggunaan alat muzik tradisional/moden dibenarkan
7) Setiap lagu tidak melebihi 4 minit
8) Penilaian
a. Saringan (10% undian pendengar dan 90% panel juri)
b. Pertandingan Akhir (20% undian pendengar dan 80% panel juri)
9) Penghakiman berdasarkan kualiti lagu dan lirik sahaja berdasarkan lirik lagu, susuan muzik dan senikata lagu
10) Penilaian juga diberikan kepada aspek kreativiti melodi yang bermutu, bernilai komersial dan menepati konsep serta mampu menarik minat semua golongan

25 to 27 May

: CIPTA EKSPRES 2010

This year’s Cipta Ekspres was held from 25th to 27 May 2010 at Residence Desa Lagoon Resort, Port Dickson. A total of 22 composers, lyricists and arrangers participated at the event.

16 composers were divided into 8 groups with each group comprising one established and one new and promising songwriter. Composers Julfekar, Aizat Amdan, Andy Flop Poppy, Nik Nizam, LY, Noh Hujan, Zul Mahat, Bard Muffin, Ramli Sarip, Omar K, Pacai, Intan Norul, Dakmie, Zimie Sofaz, Sohaimi Mior Hassan and Anna Raffali join lyricists Farah Asyikin, Radifah 3R, Tessh RS and Ahmad Altimet and came up with 10 brand new songs! Gregory John Henderson & Is Wow helped with the arrangements of some of the songs.

The annual event was organized by MACP’s MDF Committee and Alfa Booty, Ad Samad, Aidit Alfian together with Ms Chan and Asiah

10 May

: Anti-Piracy Campaign Launch

The long-awaited official launch of the anti-piracy campaign by Deputy Prime Minister, Tan Sri Muhyiddin bin Hj Mohd Yassin will take place on 10 May 2010, 3pm at KL Sentral, Kuala Lumpur.

MACP is one of the Special Anti-Piracy Task Force (SAFF) members representing the music, books, movies and software industries in a full enforcement crackdown against all forms of piracy with the following 4 key goals :-

1) Clean up the shopping malls – to reduce all forms of piracy in shopping malls and hotspots
2) Stop the downloading – to take down infringing websites and stop illegal mobile device downloads
3) Get business to be compliant – reduce corporate end user piracy
4) Cripple piracy syndicates – use anti-money laundering legislation & other measures to fight piracy

The SAFT is led by the Ministry of Domestic Trade, Cooperatives and Consumerism and various government agencies and is a nationwide effort coordinated with various national agencies.

: DIVA System in MACP

MACP joins MCSC in China and MUST in Chinese Taipei to use DIVA, the membership, documentation & distribution system developed by CASH, Hong Kong SAR. DIVA was recently installed in MACP and a training conducted by Flora, Documentation Specialist and Betty, Deputy Head, Documentation & Distribution and Alfred, Acting Head IT of CASH was held in MACP from 29 March to 1 April 2010.

With a strong database in DIVA especially in the international and Chinese works arising from the participation of all international major publishers, MACP will be able to concentrate on improving our distribution processes in both performing and mechanical distributions for digital works.

MACP plans to work closely with CASH, MUST and MCSC to facilitate the data exchange and we believe that this will benefit MACP members especially with the growing use of our members’ works within the DIVA family.

The DIVA system replaces Mis@Asia system which has been used by MACP since 2003 and will be used for the first time to carry out this year’s distribution.
