Why
Should I Join MACP?
If your
music is performed in public for example at pubs, clubs, festivals
and concerts or broadcast over radio and TV, you are entitled
to receive royalty payments. This is because the Malaysian Copyright
Act 1987 gives writers control over the use of their music.
The
central idea underlying MACPs existence is that it would be impossible
for authors, composers and publishers to license and collect royalties
for all the public performances and broadcasts of their work.
Similarly, it would be unrealistic to expect businesses using
copyright music to obtain permission from individual copyright
owners. The only way in which such rights can be respected and
remunerated is through collective administration i.e through MACP.
What
Are The Benefits Of Joining MACP?
A lot,
but none more important than this: the moment you become a member,
you are eligible to receive performance and broadcasting rights
royalties not only for your works performed in Malaysia but anywhere
around the world where MACP is represented by way of reciprocal
agreements with similar authors society worldwide.
There
are other less tangible benefits to joining MACP. As a member,
youll have the support of MACP staff who can provide advice on
certain issues that may affect you and your career. You will also
be able to participate in a range of member activities such as
workshops, seminars, annual dinner, sports and various industry
showcase events for free. MACP also purchase group personal accident
insurance policy for its members.
How
Do I Join MACP?
Membership
to MACP is free and all applications are to be forwarded to the
Public Relations & Membership Department (Pn.
Asiah). You can send in your application via
e-mail in the form available on this website.
What
Is The Criteria For Joining MACP?

Writer Members |

You
are the original composer and/or lyricist of musical work; |
| 2. |
You
are a Malaysian citizen or permanent resident of Malaysia;

| 3. |
You
are not currently a member of another performing rights society; |
| 4. |
At
least five (5) of your musical work is published and recorded
or if you are a jingle writer, twenty-five (25) of your compositions
have been performed publicly/broadcast. |

Membership is on an individual basis. If you co-write musical
works with another person, he or she can also apply for membership.

The applicant must publish a minimum of 50 works which have
been recorded for commercial release and the writers must
be members of MACP or any of its affiliated society. |

Why
Must I Sign The Deed of Assignment Before I Can Be A Member Of
MACP?
This
Deed of Assignment is necessary to enable MACP to administer and
act on a members behalf. By the Deed of Assignment, the member
assigns to MACP all performing rights as they subsist in all countries
of the world in all musical works which now belong to or shall
thereafter be acquired by or vested in the member. By the same
Deed of Assignment, MACP covenants with the member that it will
pay to the member such sums of money out of the moneys collected
by MACP in respect of such rights assigned to MACP, based on Distribution
Rules fixed by the Board of Directors.
Can
I Be A Member Of A Foreign Collective Administration Society?
You
are free to join any foreign rights administration society. If
you migrate overseas, say to Australia, you can opt to transfer
your membership to APRA (our affiliated society in Australia).
Please inform us of your decision and MACP will act accordingly.
Please note that you can only join one collecting society at any
point of time. If you are a member of a foreign affiliated society,
MACP will see to the administration of your rights in Malaysia
and will send the royalties abroad to the collective administration
society of your choice. The latter will then remit your royalties
to you.
As
Member Of MACP, Will I Also Receive Royalties When My Works Are
Used Abroad?
MACP
has concluded reciprocal representation agreements with about
100 foreign affiliated societies. These societies represent MACPs
members interests abroad. For example, if one of your works is
performed at a concert abroad, the local organisers must pay the
corresponding royalties to the society in that country. The latter
will remit the royalties to MACP which will pass them on to you.
But you must notify us in advance of the concert overseas to enable
us to inform and register your works with that society.
How
Do I Register My Works With MACP?
Members
should notify all their published works by completing the "work
cards" (which can be obtained from MACP) and returning them to
MACP as soon as your compositions are recorded and commercially
released. These cards are important as the information supplied
shall determine the amount of royalty income distributed to you
for performance and broadcast of each of your works in the future.
If your publisher is a member of MACP, the registration is normally
done by your publisher. But you should check the works registered
with MACP to ensure that all your compositions are properly registered
with us by asking MACP to print a list of your works for your
verification.
Notification
of music used in a film and commercial jingles should be registered
under separate forms (which can be obtained from MACP) indicating
all the necessary information as requested.
How
Often Does MACP Distribute Its Royalty?
Currently
MACP distributes its royalty once a year, unless the situation
warrants or requires that more distribution be made in a year.
