Raid Against A KTV Lounge & Bistro
On 11 October 2004 and in an unprecedented move, MACP and Music Publishers Association Selangor & Federal Territory (MPA) together with enforcement officers from the Ministry of Domestic Trade & Consumer Affairs (DTCA) conducted a raid on a KTV lounge & Bistro in Cheras for committing several copyright offences.
This raid was led by Encik Izami Nazuri, DTCA's Special Copyright Team Deputy Director , and conducted in reference to Section 41(3) of The Copyright Act 1987. Under this section, “Anyone who causes a literary or musical work to be performed in public shall be guilty of an offence under this subsection”. The penalty imposable range from a minimum of RM10,000 to RM50,000 and/or imprisonment up to 5 years for each offence.
During the operation, the raiding team also found music infringing articles at the business premises which was also suspected of committing an offence under Section 41 of the Copyright Act. The fines for offences under Section 41(1) ranges from RM2,000 to RM40,000 for each song infringed or imprisonment of up to 10 years or both. A few equipments used for playing music to the public were also seized from the business such as audio visual equipments, TV monitor, amplifiers, microphones, song books and computerised karaoke server.
All commercial businesses are reminded to comply with the requirement to obtain MACP public performance licences since more complaints will be lodged with the Ministry in the future if they refused to abide with the Copyright Act 1987.
WIPO-CISAC Joint Training On Collective Management Of Copyright And Related Rights
MACP was very honored when WIPO and CISAC announced that Kuala Lumpur was chosen as the venue for a joint training course organized by the two international organizations. The course named “WIPO-CISAC Joint Training Course On Collective Management of Copyright and Related Rights” was held from November 8 to 12, 2004 at the Crown Princess Hotel, Kuala Lumpur . The 21 participants were foreign delegates representing sister collecting societies or government officials in charge of copyright from countries such as Thailand , Phillipines , Singapore , Vietnam , Fiji , etc.
A few speakers (including four of MACP's managers) had been invited to speak on various topics. Among them were Mr. Scot Morris, Director of International Relations, APRA who talked on “Artists and Composers' Legal Rights” and “Services To Members”, Mr. Edmund Lam, Chief Executive Officer, COMPASS who delivered on “ New Areas and Challenges in Royalty Collection”, Mr. Seiji Odaki, Chief International Relations Department, JASRAC on “ Collecting Royalties for Mechanical Rights: The Team, Method and Compensation” and also Mr. Manisekaran Amasi, Director of Malaysian Copyright Division, Ministry of Trade & Consumer Affairs who touched on “ The Role of Government in the Development of Collective Management Organizations”.
This course also included a trip to MACP's office on 10 November 2004 .
